All samples are returned to the laboratory in compliance with Chain of Custody procedures for analysis. A result is then reported against European legally defensible workplace guideline cut-off levels. However, if the organisation wishes they can decide on their own cut-off levels.
- To be a legally defensible result to European Workplace guidelines, the sample needs to conform to a number of their requirements.
- The sample is to be a gold standard sample of either urine or saliva. The sample will provide a concentration level and be analysed for adulterants and abuse.
- The laboratory will look for specific metabolites of the drug, showing it has been consumed and is not just contamination.
- The report will show a level of concentration of that metabolite, above which, the EWDTS consider it a ‘positive’ result.
- This positive concentration result from the legally defensible guidelines is what you can work with in your disciplinary hearing.
This needs to be specified within your Drug and Alcohol Policy and with the laboratory.
